Coastal Zone Management (CZM) Program and States Entitled to Review Proposed OCS Activities Based on "Coastal Effects" on State Resources or Uses (15 CFR 930.11(g))
The Director of the Bureau of Ocean Energy Management, Regulation and Enforcement (BOEMRE) has identified the geographical areas of Outer Continental Shelf (OCS) where OCS activities would have CZM Act "reasonably foreseeable coastal effects on State resources and uses" for the Gulf of Mexico coastal States under current policy. Accordingly, if an Exploration Plan, a Development and Production Plan, a Development Operations Coordination
Document, or a right-of-way (ROW) pipeline application proposes activities in these geographical areas, the OCS plan or ROW pipeline application is then subject to Federal CZM consistency requirements. For the State of Texas only, a ROW pipeline must intersect the State's territorial waters to meet the geographical criteria. Additional nongeographical triggers for "coastal effects" and the types of OCS activities subject to consistency review are outlined in NTL 2008-G04 and NTL 2007-G20.
The OCS geographical areas that have "coastal effects" from OCS activities on the coastal States of Texas, Louisiana, Mississippi, Alabama, and Florida under current policy are depicted on the following figures:
